OCCUPANCY LEDGERS
- Question: Why does
the Association need to have the Occupancy Ledger?
Answer:
Because your unit is situated in the midst of common area structures and
property, the Association must be able to contact the legal owners and tenants
for emergencies or common area maintenance issues. The
information is needed to provide the Owners and Residents access to the grounds
and the use of the common area facilities at Stoneybrook Villas. Gate and
postal directories should list all of the residents who want to be so listed.
The Association needs the information to provide the proper safety and security
for the Association and its Owners and Residents and its proper functioning.
- Question: What is a
Mortgagee?
Answer:
A Mortgagee is a bank or other lender that holds a security interest in your
Unit. The Association is required by the CC&R’s to maintain a roster of
Mortgagees because their approval may be required for certain actions by the
Association, such as changing the CC&R’s in ways that affect their security
interest.
- Question: Why do we
need to list our parking spaces?
Answer: Periodically
the Association needs to contact the owners of parking spaces in order to take
care of Association Emergencies or Maintenance.
Also, Vehicle Gate Openers (VGO’s) can only be held by
persons who have access to a space at Stoneybrook Villas. Such person must be
listed on an Occupancy Ledger. If an Owner rents out one of their parking
spaces it must be rented to a person who resides at Stoneybrook and a notation
must be made on their Occupancy Ledger of the Unit in which that person who is
renting the space resides. A notation must also be made on the Occupancy
Ledger for the Unit in which that person resides of the parking space and the
Unit from which it is being rented.
- Question: Why must
the Owner’s section show the exact legal title in which ownership is held?
Answer:
Notices and voting rights are based on the persons who legally own the Unit. If the Unit is owned by a Trust
then the Trust must be listed as the owner and the name or names of the
Trustee(s) of that Trust need to be shown. This information is on the Deed by
which you acquired and/or hold title to the Unit.
- Question: Why must
the Owners sign the Occupancy Ledger?
Answer:
The Owner(s) of the Unit need(s) to know who is residing in the Unit and using
the common area facilities. They need to be sure they and the residents of their
Unit have access to and are aware of the Association Rules (The CC&R’s,
Bylaws and Rules are available on this website at sbgovdocs.html).
Under the Governing Documents, the Owner will be held responsible for their own
and the actions of their residents and guests at Stoneybrook Villas. The
Association needs to know the Owners accept this responsibility for their
residents and guests.
If you have not yet
submitted your Occupancy Ledger please do so as soon as possible. It is needed
in order to use the new Entry Control System that has been implemented. Complete and accurate information is important.
